Compensation
- MBD is only liable to compensate any losses suffered by the Client due to the damages or losses of the document or goods submitted for shipment by MBD as long as the loss happens while the goods or documents are within MBD control, and caused by the negligence of MBD employees or agents.
- MBD is not responsible for any consequential damages arising out of foregoing events, such as the loses including those happened during transportation or delivery caused by disaster or Force Mejeure (Act of God).
- The MBD liability is in accordance with the terms and condition contained in clause 8 point (i) above is in the form of compensation of damages or losses of documents or goods which value does not exceed 10 times shipping expenses or its equivalent, for each for shipment destined within Indonesia and US$ 100.00 or it's equivalent for shipment destined to country outside Indonesia. The determination of the liability value of MBD is by taking into consideration the value of the documents or the goods replacement at the time and place of shipment, disregarding the commercial value and consequential losses as contained in chapter 8 point (ii) above.
